Queens DWI Overview
One of the most common ways for a person to be arrested for DWI in Queens is to have a police officer observe him commit what the officer believes is a violation of a traffic rule. The police will then pull the motorist over and claim that he smells alcohol on the driver's breath.
If the driver admits to drinking, that is usually enough to have the motorist arrested. The motorist will then be taken to the local precinct. There you will be asked to take a breathalyzer. Once you have taken the test and the result is over .05 BAC you will be processed for DWI.
You will then see a judge and will be released if you do not a criminal record or a record of not returning to court. You will then be given another court date to return and address your case.
