The NYPD uses the Intoxilyzer 5000. A sensor at the far side of the Intoxilyzer 5000 measures the amount of infrared light of these particular frequencies. The less light that gets through, the higher the reported value of the driver’s BAC. This machine has some serious flaws. First, the machine does not take into account the subject's weight nor how much he has to drink.
It also does not measure the subject's body heat. Body temperature is very important when it comes to determining how much alcohol is in a person's blood. The machines in New York City also tend to be very old and have been used for years without proper service. The major problem is that these machines determine a great number of things. If the BAC is too high, prosecutors will demand jail time and that the defendant plead guilty to a criminal record.
